Terms of Use

By accessing or using the DAC Academy ERP platform, you agree to be bound by these Terms of Use. Please read them carefully before using the system.

1. Platform Purpose

The DAC Academy ERP is an institutional management platform developed by TestLearn and operated by DAC Academy. The platform is designed exclusively to support the administrative, academic, financial, and hostel management operations of the institution.

The platform provides functionality for managing student records, admissions, fee collection and reconciliation, hostel administration, parent communication, staff accounts, and system audit logs.

2. Authorized Users

Access to this platform is restricted to individuals who have been expressly authorized by DAC Academy. Authorized users include:

  • Academy administrators assigned to an institutional branch
  • Counselors and academic staff with role-appropriate access
  • Hostel wardens responsible for student accommodation management
  • Parents and guardians registered against an enrolled student's account

Accounts are issued and revoked solely at the discretion of DAC Academyadministration. The right to access this platform is not transferable.

3. Account Responsibilities

Each user is responsible for maintaining the security and appropriate use of their account. By using this platform, you agree to:

  • Keep your login credentials confidential and not share them with any other person
  • Notify the academy administrator immediately if you suspect unauthorized access to your account
  • Use only the account assigned to you — using another user's account is prohibited
  • Ensure that your account information is accurate and up to date
  • Log out of your session when using shared or public devices

4. Password Responsibilities

You are solely responsible for the confidentiality and security of your password. The following obligations apply to all users:

  • Do not share your password with colleagues, family members, or any other person
  • Do not use easily guessable passwords such as birthdates or common words
  • Change your password immediately if you believe it has been compromised
  • Do not reuse passwords across multiple systems or platforms
  • The institution will never request your password via any channel — treat any such request as fraudulent

Passwords are stored as irreversible cryptographic hashes. The platform does not store or have access to your plaintext password.

5. Authorized Usage

You may use the DAC Academy ERP platform for the following purposes:

  • Performing your assigned institutional role and responsibilities
  • Accessing student, fee, or hostel data within your authorized scope
  • Generating legitimate institutional reports and receipts
  • Communicating with students and parents through provided platform channels
  • Submitting and reviewing approved workflow actions (admissions, outings, fee waivers, etc.)
  • Viewing your assigned student's records (parents only)

6. Prohibited Usage

The following actions are strictly prohibited and may result in immediate account suspension, legal action, or both:

  • Attempting to access accounts, data, or system areas beyond your authorized scope
  • Attempting to bypass, exploit, or circumvent the platform's authentication or access controls
  • Accessing, modifying, or deleting another user's records without authorization
  • Using automated scripts, bots, or crawlers to interact with the platform
  • Tampering with financial records, receipts, or audit logs
  • Sharing confidential student or parent data with unauthorized parties
  • Using the platform for any purpose unrelated to academy operations
  • Intentionally introducing errors, malware, or harmful data into the system
  • Reverse engineering, decompiling, or attempting to extract the platform's source code

7. Data Ownership

Data ownership is clearly defined between the two principal parties:

DAC Academy

DAC Academy retains full ownership of all institutional data processed through this platform, including student records, fee records, staff data, and all associated content.

Software Platform Owner

TestLearn

TestLearn retains full ownership of the ERP software platform, including its design, architecture, source code, and all associated intellectual property.

TestLearn processes institutional data strictly on behalf of DAC Academy and does not claim any ownership over institutional data.

8. Service Availability

The DAC Academy ERP platform is provided on a best-effort basis. While every reasonable measure is taken to maintain high availability:

  • Scheduled maintenance windows may result in temporary service interruption
  • Unplanned outages may occur due to infrastructure, network, or third-party service failures
  • No guaranteed uptime is warranted unless expressly stated in a separate service agreement
  • Users will be notified of planned maintenance where operationally feasible

9. Limitation of Liability

To the fullest extent permitted by applicable law:

  • TestLearn shall not be liable for any indirect, incidental, special, or consequential damages arising from use of or inability to use the platform
  • TestLearn's liability is limited to the extent of the service provided and governed by any separately executed service agreement with the institution
  • DAC Academy is responsible for ensuring that platform users within its organization comply with these Terms of Use
  • Neither party is liable for failures attributable to force majeure events, third-party infrastructure failures, or actions taken in good faith

10. Account Termination

Accounts may be suspended or permanently terminated under the following circumstances:

  • Violation of any provision of these Terms of Use
  • Resignation, termination, or change of role for staff accounts
  • Student unenrollment or graduation (for parent accounts)
  • Prolonged account inactivity as determined by academy policy
  • Request by the authorized academy administrator
  • Detection of fraudulent, abusive, or unauthorized system activity

Account data is retained in accordance with the Privacy Policy following account termination. Audit logs associated with terminated accounts are preserved indefinitely.

11. Intellectual Property

All intellectual property rights in the DAC Academy ERP platform — including but not limited to software code, design systems, user interface elements, workflows, and documentation — are the exclusive property of TestLearn. These rights are protected by applicable intellectual property laws.

Users are granted a limited, non-exclusive, non-transferable right to use the platform solely for the authorized institutional purposes described in these Terms. No license, right, or title to any intellectual property of TestLearn is transferred to any user or to the institution.

The DAC Academy name, branding, and institutional materials remain the property of DAC Academy.

12. Amendments to These Terms

These Terms of Use may be updated from time to time. The institution and TestLearn reserve the right to modify these terms at any time. Changes will be reflected by updating the effective date. Continued use of the platform following any revision constitutes your acceptance of the updated terms.

13. Governing Law

These Terms of Use shall be governed by and construed in accordance with the laws of India. Any disputes arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the competent courts of India.
